  In order to ensure the effective implementation of the relevant requirements for personal information protection in the Cyber Security Law and improve the personal information protection level of network operators, the Central Network Information Office, the Ministry of Industry and Information Technology, the Ministry of Public Security and the National Standards Committee jointly held the launching meeting of the "Personal Information Protection Promotion Action" and the establishment meeting of the expert working group to launch the special work on privacy clauses. The first batch will review the privacy clauses of ten online products and services such as WeChat and Taobao.

  Privacy clause is the window for users to know about the collection and use of personal information of products or services, and it is the primary channel for users to exercise the right of choice and consent given by law. Network operators should, in accordance with legal requirements, standardize the content, presentation form and location of privacy clauses, and obtain users’ consent through privacy clauses. At the same time, some people have doubts about the special work of privacy clauses. They think that on the one hand, the privacy policy is too long for users to read at all; On the other hand, the special work of privacy clause is aimed at personal information collection, but in the era of big data and Internet of Everything, it is impossible to control personal information collection. With the gradual spread of the special work of privacy clauses, the author believes that the review of privacy clauses is helpful to improve the level of personal information protection and should not give up the control of personal information collection.

  The special work of privacy clause can improve the effect of notification

  The most important purpose of privacy clause is to inform users. And notification is a clear requirement of China’s current laws. Whether it is the Decision of the National People’s Congress Standing Committee (NPCSC) on Strengthening the Protection of Network Information in 2012, the Law on the Protection of Consumers’ Rights and Interests in 2013, or the Cyber Security Law implemented in June 2017, individual consent is always regarded as the main legitimate reason for personal information controllers to collect and use personal information. "Agree" must be the expression of the user’s true will. In order to ensure this, notification becomes a very necessary step.

  Some scholars have suggested that the framework of "inform-agree" is that the privacy policy is long and obscure, and the user is eager to use the product or service, and may directly click "agree" or "next". However, since personal information can identify specific individuals and reflect their thoughts, opinions, preferences and actions, individuals will be concerned about how their personal information is collected and used. Then, the reason why individuals show "indifference" now is that the content of privacy policy is not well displayed.

  In fact, the special work on privacy clauses has made detailed consideration on how to effectively improve the effect of notification:

  The first is the privacy policy, whose function is to completely and clearly describe the practices of product and service providers in collecting, saving, using and providing personal information to the outside world. Although this text is often criticized for its length, the readers of privacy policy are not only users, but also regulators and consumer protection groups. Generally speaking, the privacy clause is a public statement of network operators on their personal information processing behaviors such as collection, storage, use, sharing and transfer, which is not only a legal commitment to users, but also an important basis for network operators to carry out law enforcement and social supervision.

  The second is enhanced notification, that is, registering an account, installing a program, and prompting the user about personal information when using it for the first time. It is not a text of privacy policy, but it condenses the core content of privacy policy, or highlights the information that users are most concerned about, such as what personal information is collected and to whom it will be provided. Many times, the enhanced notification contains a link to the complete privacy policy text. The advantage of this is that even if users don’t read the text of privacy policy, they can know the key core content of privacy policy and the high-risk personal information processing behavior through enhanced notification.

  The third is instant prompt, that is, prompt about personal information processing behavior displayed immediately during the user’s use. It is often used to inform personal sensitive information before the second authorization. Personal sensitive information refers to personal information that may endanger personal and property safety and easily lead to personal reputation, physical and mental health damage or discriminatory treatment once leaked, illegally provided or abused. Generally speaking, personal privacy information belongs to personal sensitive information. Then, before these personal sensitive information are collected, used or provided to others (including sharing, transfer and public disclosure), users need to be reminded again, because such information is of great significance to users. From the user’s point of view, the behavior of handling personal sensitive information should not only be buried in the text of privacy policy, but should be highlighted and highlighted, with the consent of users. This is a good way to practice the concept of "user-centered".

  In addition to these three forms, there are also platform-based apps. There are more single-function apps abroad, and platform-based apps are very common in China, so it is necessary to integrate many other functions. These functions may be subject to the same privacy policy, or they may have their own special provisions. Therefore, when users click on these additional functions, the providers of products and services should provide a separate notice to inform users in a targeted manner what the additional functions will do to personal information that is different from the unified privacy policy.

  In fact, notification can not only be achieved through long privacy policy texts, but also through various paths in reality. If enterprises really adhere to the concept of "user-centered", they should be more creative so that ordinary users can truly feel the sincerity and temperature of products and services.

  We should not give up the control of personal information collection.

  Comply with the trend of the times and give up the control of the collection link, which is a typical embodiment of the supremacy of technical logic and growth. Scholars who hold this view often think that the development of artificial intelligence should be domesticated through the power of ethics and law. In fact, this debate is not unique today. In 1980, the Organization for Economic Cooperation and Development (OECD) issued a "Privacy Guidelines" guide. After entering 2000, OECD hopes to update this guide according to the characteristics of the times and technological development. Many experts convened by the OECD suggested that the 1980 guide had requirements for collection, but whether it was suitable for future development needed to be re-evaluated. After the debate, experts reached a consensus that the collection of personal information needs to be controlled. Therefore, in the updated Privacy Guidelines issued in 2013, the "collection restriction principle" was placed at the top of the eight principles of personal information protection.

  It is generally believed that the protection of personal information in the United States is relatively loose, so the Internet has developed rapidly in the United States. The protection of personal information in Europe is too strict, so there are basically no decent Internet companies in Europe. But the complexity of the reality far exceeds the above simple comparison. Taking the "Privacy Protection Rules for Broadband Service Providers" formulated by the Federal Communications Commission (FCC) as an example, a framework is established in this rule: personal sensitive information should adopt the opt-in mode, and personal non-sensitive information can adopt the opt-out mode; Both personal sensitive information and non-sensitive information need to be clearly informed, and users should be provided with the right to withdraw their consent. It can be seen that the framework formulated by FCC is to strengthen the control of the collection link.

  However, this rule was overturned by the US Congress not long ago. The important reason is that the framework of FCC for broadband service providers is actually stricter than the privacy protection framework of FTC for non-broadband service providers (such as Google and Facebook). Therefore, it will cause discrimination against broadband service providers in competition. However, at least ten states in the United States then tried to pass legislation at the state level to restore the framework established by the FCC.

  A few days ago, Nevada also passed legislation to formally require website operators and network service providers to provide privacy policies on their websites, and put forward specific requirements for the content of privacy policies. The bill will take effect on October 1, 2017.

  To sum up, the biggest market for the idea of "abandoning the collection of personal information and controlling the use of it" is in the United States, but by simply tracking the development of news and legislation, it can be found that even in the United States, such a view has not been fully accepted by legislators and regulators. First, effectively increase the intensity of investigation and handling.

Our bureau is organizing a "blue sky" campaign, which will punish a group of patent agencies that have a large number of abnormal patent applications and are suspected of fabricating patents by stopping undertaking new business until their practice licenses are revoked. At present, they have entered the stage of informing before punishment. All localities should, according to the notification information about the abnormal patent application agency behavior, investigate and deal with the cases under the key supervision of our bureau and the agencies that repeatedly represent abnormal patent applications as soon as possible according to law, and severely punish them; If the circumstances are serious, it may be reported to our bureau to stop accepting its relevant agency business or revoke its patent agency qualification.

Second, strictly implement collaborative governance measures

Our bureau will determine a list of institutions that need collaborative governance according to the number of abnormal patent applications and relevant circumstances, and forward it to the intellectual property offices of relevant provinces (autonomous regions and municipalities directly under the Central Government) (the list of institutions will be forwarded separately). All localities should implement strict cooperative restrictive measures in all kinds of incentive and reward policies and project support, evaluation of institutions and individuals, screening of participating units in various activities, and recommendation of relevant experts and talents. At the same time, all localities should guide local enterprises with intellectual property advantages and demonstration enterprises to carefully select and optimize patent agencies.

Three, crack down on unqualified patent agencies related behavior.

Our bureau will continue to strengthen the screening and monitoring of big data, lock in clues that unqualified institutions engage in abnormal patent applications, and promptly hand them over to the intellectual property offices of relevant provinces (autonomous regions and municipalities directly under the Central Government) for investigation. All localities should intensify their efforts to crack down on unauthorized patent agency business, investigate and deal with it strictly and quickly, and its abnormal patent application behavior should be regarded as a heavier circumstance and given a heavier punishment.

Four, strengthen the key supervision of the per capita patent agency is obviously too high.

In the early stage, our bureau has forwarded to the Intellectual Property Offices of the relevant provinces (autonomous regions and municipalities directly under the Central Government) the list of institutions with an obviously high per capita agent volume, and asked all localities to be included in the key supervision objects as required, and conduct on-site inspections and key inspections in the "double random and one open" inspection to increase the frequency of inspections. If it is found that they are engaged in abnormal patent applications, leasing and lending patent agency qualifications, they will be severely punished according to law. Our bureau will continue to pay attention to the agencies whose per capita agent volume is obviously too high and whose agent volume growth rate is obviously abnormal, and timely transfer them to the intellectual property offices of relevant provinces (autonomous regions and municipalities directly under the Central Government) for key supervision.

Five, give full play to the role of industry organizations

Local patent agency industry organizations should give full play to the role of industry self-discipline, strengthen the self-discipline and punishment of acting as agents for abnormal patent applications, organize local activities of "promoting integrity and improving quality", cooperate with the establishment of industry voluntary supervision mechanism, strengthen special business training and policy propaganda, and guide local patent agencies and patent agents to consciously resist abnormal patent applications.

Six, strengthen the agency supervision work assessment.

Our bureau has incorporated the work of cracking down on the abnormal patent application and agency supervision into the assessment of local intellectual property protection this year, and will evaluate the progress and quality of cases transferred and supervised by our bureau in various places. At the same time, we will dispatch professionals to relevant places to conduct on-site supervision of key cases. All localities should further increase their attention, strengthen the allocation of agency supervision power, fully perform their supervisory duties, comprehensively strengthen agency supervision, resolutely curb the agency’s abnormal patent application behavior, and promote the healthy and orderly development of the agency industry.

Can the end-to-end model solve the last mile problem of autonomous driving?

In smart car technology, high-level autonomous driving is a difficult problem that major manufacturers and most Internet giants are trying to overcome. Whoever can take the lead in promoting the landing of advanced autonomous driving technology will be able to take the lead in automobile sales. In the high-order autonomous driving technology, the end-to-end model is the most discussed by all parties.

Compared with the previous model, end-to-end seems to have become the only way for advanced autonomous driving. So what is the end-to-end model? What is the development trend of end-to-end model in China? These problems are worthy of people’s attention.

What is an end-to-end model?

Speaking of the end-to-end model, it is natural to be inseparable from the ChatGPT of this year’s fire. ChatGPT itself is an end-to-end model, that is, by inputting words, customers can get the answers they want.

Whether it’s PPT or video, ChatGPT and other big models may spit it out. In this process, the most critical is the AI model. It can gain insight into users’ needs and produce the content they need.

In the field of autonomous driving, the most famous end-to-end model is Tesla’s FSD V12. The input of this model is all kinds of image data obtained by the camera; The output end is the vehicle control instructions, including steering, acceleration and braking. In the middle, it is a big model that Tesla is proud of.

In the scene of end-to-end model, when the vehicle recognizes some traffic signs or encounters various situations, it will automatically judge according to the past learning situation, instead of looking for a solution to this problem in the code according to various preset preconditions like the traditional model.

What are the advantages of the end-to-end model?

In contrast, in the past, the traditional autopilot model was based on the working conditions set by engineers in advance. The choice of driving behaviors, including lane changing, parking and even overtaking, has been set in advance. This will bring two problems:

Autopilot models are becoming more and more complex. Since each module usually only performs one driving behavior, the automatic driving algorithm needs to include the driving behavior of human drivers as much as possible. Therefore, the code of traditional autonomous driving technology usually has hundreds of thousands of lines of code. This will bring higher and higher requirements for the computing power of smart driving chips. Tesla’s FSD V12 has only 2000 lines of code; While FSD V11 has an astonishing 300,000 lines of code.

Unable to solve the long tail condition. No matter how full the preliminary test and certification are, no autopilot algorithm can say that all the long tail conditions are included. Then once you meet a new long tail working condition, it is very likely that traffic accidents will occur and even life injury accidents will occur.

The best case is that the project operated by GM’s Cruise in California encountered various working conditions that had not been encountered in the previous experimental stage at the beginning of its launch, which led to casualties, forcing the California Highway Bureau to suspend the license of Cruise for a time.

Where is the end-to-end difficulty?

To achieve an end-to-end model, there are two main limiting factors: massive data and large computing power. Only with the blessing of these two factors can the end-to-end model land. In order to make the end-to-end model closer to human drivers, its large model often needs to contain hundreds of millions of parameters. Only with more parameters can the driving characteristics and habits of human drivers be better simulated, and the performance of the model will be better. In these two areas, Tesla has a clear first-Mover advantage.

Not long ago, Tesla just got the certification of domestic data security and privacy protection, and was allowed to enter the government department compound. The reason why Tesla didn’t get the relevant recognition before was that the cameras in each car were collecting all kinds of data in real time and uploading them to the server for training the FSD algorithm.

Looking around the world, Tesla’s newly sold models every year are constantly providing data for the FSD V12 algorithm for the latter to continue to optimize learning.

It is worth mentioning that Tesla’s car also has a "shadow mode". It will compare the deviation between the driving behavior of the owner and the driving behavior determined by the automatic driving system, upload the relevant data together, and also optimize the algorithm.

At the same time, in order to be able to calculate the massive data collected, Tesla also needs a supercomputer center. The core of supercomputing center is the large computing power chip. For this reason, Tesla not only bought a large number of NVIDIA H100 chips, but even developed Dojo chips. The unit price of the former is as high as $35,000, while the investment in research and development costs of the latter is hundreds of millions.

For any enterprise, this is not a small expense. Domestic car companies have basically not been able to develop their own large computing chips. NVIDIA H100 chip has already become a product on the export control list of the United States, and it is difficult for domestic car companies to obtain it.

So is it possible to achieve the end-to-end model with massive data and large computing power? The answer is also no.

From the above description, we can find that the end-to-end model is actually a "black box". If there is an error in the model operation, it is actually difficult for researchers to find out what part of the model is wrong and directly adjust the model.

Theoretically, only through more training, or increasing more parameters and trying to adjust some model parameters can we try to solve the problem. Therefore, whether the autopilot model based on end-to-end technology can finally meet the needs of autopilot technology at the safety level is still very uncertain.

Even so, compared with the traditional autopilot model, the advantages of the end-to-end model are very obvious. Especially when solving the long tail condition, the end-to-end model can give play to the incomparable advantages of the traditional autonomous driving technology model. At present, some new car companies, such as Huawei, Tucki, Weilai and Ideality, have started to introduce the end-to-end model in the domestic market.

Aside from Huawei, which has abundant capital, it is a big challenge for new car companies with limited capital accumulation to balance the input and output returns of end-to-end technology. Not to mention, it is not an easy task to buy large computing chips in China at present.

With the high probability of the end of the year, Tesla FSD V12 will enter the domestic market. What changes will take place in the domestic market structure of autonomous driving technology at that time, which deserves people’s attention.
