Six departments remind: guard against the risk of "consumer rebate" and guard against the loss of interests.

Cctv newsAccording to the website of the State Administration of Markets, the Insurance Regulatory Commission of the Bank of China, the Ministry of Industry and Information Technology, the Ministry of Public Security, the Ministry of Commerce, the People’s Bank of China and the State Administration of Markets recently issued tips.

The prompt shows that recently, some third-party platforms, under the banner of "starting a business" and "innovation", take "returning money from shopping", "spending equals making money" and "you spend and I will pay back the money" as gimmicks, and promise to return high or even full amounts of spending money and joining fees, so as to attract consumers and businesses to invest. This kind of "consumer rebate" is different from the normal business rebate promotion activities, and there are great risks.

  The details are as follows:

First, high rebates are difficult to achieve. Rebate funds mainly come from commodity premium income and fees paid by members and franchisees. Most platforms do not have legitimate real economy and income matching their promised returns, so it is difficult to maintain capital operation and high rebate for a long time.

Second, the security of funds cannot be guaranteed. Some platforms absorb public and business funds through online and offline channels, such as "prepaid consumption" and "recharge", and a large amount of funds are controlled by the platform, which has the risk of transferring funds and running away.

Third, there are illegal risks in the operation mode. Some platforms fictionalize profit prospects, promise high returns, instruct or acquiesce members and franchisees to fictionalize commodity transactions, pay a certain percentage of fees directly to the platform, and seek high rebates. In this way, the platform achieves the goal of quickly absorbing public funds. Some platforms also use pyramid schemes, with the so-called "dynamic income" as bait, requiring participants to pay entry fees and "attract people to join" and get commissions by developing offline. The above-mentioned behaviors of the platform and participants are characterized by illegal fund-raising and pyramid schemes.

The operation mode of such platforms violates the law of value, and once the capital chain breaks, participants will face serious losses. According to the relevant regulations, participation in illegal fund-raising is not protected by law, and you are at your own risk and responsibility; It is illegal to participate in pyramid schemes and will bear corresponding responsibilities according to law. The general public and businesses are requested to be vigilant, enhance risk prevention awareness and identification ability, and prevent damage to interests. At the same time, the clues of illegal crimes can be actively reflected to the relevant departments.

Service consumption is the new engine to expand consumption.

Consumption is the ultimate demand, which is not only the ultimate goal and motive force of production, but also the direct embodiment of people’s needs for a better life. General Secretary of the Supreme Leader pointed out that it is necessary to establish an effective system to expand domestic demand, release the potential of domestic demand, speed up the cultivation of a complete domestic demand system, strengthen demand-side management, expand household consumption, and upgrade consumption levels, so as to make the construction of a super-large domestic market a sustainable historical process. Since the beginning of this year, China has effectively coordinated epidemic prevention and control and economic and social development, intensified macro-policy adjustment, effectively implemented a package of policies and measures to stabilize the economy, and withstood the downward pressure on the economy brought about by unexpected unexpected unexpected factors. However, we should also see that the foundation of China’s economic recovery is still unstable, the contradiction of insufficient demand is still outstanding, and the recovery of consumer demand is still weak. To enhance the basic role of consumption in economic recovery, we must conform to the new trend of consumption structure upgrading and give play to the traction and driving role of service consumption in expanding consumption.

The development of service consumption in China presents three major trends.

Service consumption is an important force to release consumption potential. With the growth of residents’ income and the expansion of middle-income groups, China’s consumption structure has been accelerated, and the trend of residents’ consumption service has accelerated, which has become an important driving force for expanding domestic demand. In recent years, communication services, mass catering, culture and entertainment, leisure travel, education and training, health and wellness are becoming new consumption hotspots. In 2019, China’s per capita service consumption expenditure was close to 10,000 yuan, accounting for 45.9% of residents’ per capita consumption expenditure, and the consumption structure accelerated the transformation from physical consumption to service consumption. From the international experience, the proportion of service consumption in the final consumption of major developed countries is about 74% on average. In 2021, China’s per capita GDP has reached $12,500, and the increase in the proportion of service consumption will be the general trend.

Different from the development stage of service consumption in developed countries, China’s accelerated development of service consumption is in the period of a new round of scientific and technological revolution and industrial transformation, in the period of residents’ pursuit of high-quality life in the new era and new stage, in the period of demographic changes and younger consumers, showing a series of new characteristics.

First, the development of service consumption and the rapid rise of digital economy meet, showing a trend of accelerating digitalization. A new generation of digital technologies, such as big data, 5G and artificial intelligence, have rapidly penetrated into the field of service consumption, accelerating the online and offline integration of service industry, enriching service consumption scenarios, improving service consumption experience, promoting service consumption reform, and promoting more effective matching between service supply and service consumption demand, which has provided a strong impetus for the development of new service consumption formats and new models.

Second, the development of service consumption and residents’ pursuit of high-quality life meet, showing a trend of accelerating high-end. Residents’ demand for service quality and quality is increasing day by day, which accelerates the transformation of service consumption from focusing on quantity satisfaction to pursuing quality improvement. For example, in the tourism industry, the order volume of holiday four-star and five-star hotels has increased, and the willingness and ability of tourists to spend high-end has been further enhanced.

Third, the development of service consumption meets the change of population age structure, showing the trend of younger consumers. The characteristics of service consumption largely depend on the characteristics of consumer groups. With the younger consumer groups, a new generation of consumer groups with "post-90 s" and "post-00 s" as the main body pursue fashion and brands, are willing to try new things, accelerate the rise of personalized consumption, and promote the segmentation of service consumption and the development of diversified consumer markets.

In a word, the new trend of service consumption transformation and upgrading in China promotes the service market to glow with new vitality and vitality, and promotes the model innovation of service consumption and the iterative upgrading of supply.

Digital transformation promotes profound changes in service consumption.

The digital transformation of service consumption is of great significance for releasing consumption potential. Digitalization solves the problem of information asymmetry between supply and demand, and both ends of supply and demand realize quick search and matching of supply and demand information through internet platform, releasing potential consumption potential; Digitalization realizes the matching of supply and demand in time and space, guides different people to spend at the wrong peak and time, and greatly improves service capacity and service efficiency; Digitalization better meets the needs of customers, and further enhances customer satisfaction by providing customers with more customized services. With the wide penetration of digital technology into the service field, the digitalization of service consumption in China presents two new trends.

First, the digitalization of service consumption has changed from a single breakthrough to full chain coverage, which has bred new business models. At the enterprise level, digital technology is infiltrating from front-end links such as customer diversion, online order and after-sales service to back-end links such as supply chain management, personnel management and operational decision-making, opening up front-end and back-end data to enhance linkage effect and promote enterprise management efficiency. At the industry level, digital technology is extending to upstream and downstream industries along the industrial chain, promoting enterprises to digitize all business processes such as material procurement, logistics, processing, retail, distribution and financing services, improving the efficiency of resource allocation through data integration, and forming a digital ecology of service consumption. For example, with the development of technologies such as drone distribution, Beidou navigation, and 5G cloud intelligent robots, retail links, including fresh food, will realize instant point-to-point supply, and expand the development space of new formats such as direct supply of e-commerce and unmanned retail. For another example, the integration of material supply is strengthened, the trend of seamless docking is accelerated, and the intelligent level of supply chain is continuously improved, which will greatly improve the collaborative efficiency of supply system. Taking the catering industry as an example, the construction of smart restaurants further promotes the traceability of agricultural products in smart agriculture, the efficiency of procurement and distribution in smart logistics, and the convenience of financing for SMEs in financial technology, which further promotes the high-quality development of service consumption.

Second, the digitalization of service consumption expands from the demand side to the supply side, and promotes the digitalization of the entire upstream and downstream chain. With the improvement of users’ requirements for service experience such as quality and efficiency, the digitalization of demand side will force the supply side to accelerate the digital transformation and promote the shift of development focus from consumer Internet to industrial Internet. At the same time, with the reduction of the application cost of digital technology, the increase of third-party service providers and the emergence of more successful cases, the willingness of suppliers to actively promote digital transformation is increasing. If we say that in the past period, China’s consumer Internet rose rapidly, forming a number of platform enterprises in the forefront of the world. It can be expected that the development of industrial Internet on the supply side will also breed a number of large-scale platform enterprises in the coming period.

Accelerate the expansion and quality improvement of service consumption

Accelerating the expansion and upgrading of service consumption is not only an important way to expand domestic demand, but also will inject new impetus into the upgrading of consumption structure and high-quality economic development. In the coming period, efforts should be made at the levels of supply, demand and system to encourage the development of new modes and formats of service consumption and help upgrade the consumption structure.

The first is to tap the potential of the service consumption market. Expand middle-income groups, give play to the backbone role of middle-income groups in leading the upgrading of service consumption, and make them the main force of middle and high-end service consumption such as education, medical care and leisure tourism. Adhere to the positioning of "houses are for living, not for speculation", accelerate the establishment of a housing system with multi-agent supply, multi-channel guarantee and simultaneous rent and purchase, and steadily implement a long-term real estate mechanism to stabilize land prices, house prices and expectations, promote the stable and healthy development of the real estate market and reduce the crowding-out effect on consumption. Improve the holiday system, implement the paid vacation system, and encourage holiday consumption and night economic development. Support the construction of consumption center cities and cultivate international consumption center cities.

The second is to promote the structural reform of the supply side of service consumption. Further liberalize the market access of the service industry and encourage social capital to participate in the development of the service industry. Further expand the opening up of the service industry and promote the deepening reform and efficiency improvement of the domestic service industry. Improve the service industry standard system, promote the benchmarking of domestic standards and international standards, and improve the quality of service consumption. Accelerate the deep integration of online and offline service consumption, and cultivate new consumption patterns and new formats such as online retail, online education, smart tourism and internet medical care. Improve the consumer rights protection system, innovate the supervision methods, and create a secure consumption environment.

The third is to deepen the digital transformation of service consumption. Encourage the digital transformation of different sub-sectors and continuously expand the field and scope. Accelerate the service enterprises to "use the number to give wisdom" and accurately solve the problem of capital shortage of small and medium-sized enterprises through tax deduction and financial subsidies. Promote the widespread use of SaaS and other systems in small and medium-sized service enterprises, so that more enterprises can join the digital transformation process. Give full play to the advantages of data and technology of service consumption platform, and build a "internet plus" service consumption ecology. Strengthen vocational skills training, improve the digital skills of service consumers, and enhance the digital transformation ability of service enterprises.

The fourth is to increase government expenditure on public services. From the international experience, in the range of per capita GDP from $10,000 to $25,000, the increase in the proportion of government expenditure is the most significant, and this period is often the accelerated period of service consumption development. In the coming period, China’s economic development is at this stage. It is necessary to gradually increase government spending on education, medical care, housing, social security and other fields, improve the level and equalization of basic public services, further enhance residents’ service consumption capacity, and expand the development space of service consumption.

Russian ambassador to India: Russia and India are not afraid that US sanctions will promote military cooperation.

[Reporter Zhao Yanlong of Global Network Report] "Russia will not succumb to the pressure of the threat of US sanctions, and at the same time continue to finalize a large-scale military agreement with India, including four frigate contracts and the production of ak-47 assault rifles", "India will not be afraid", the Hindustan Times quoted Russian Ambassador to India Kudashev as saying on October 11th.

A week after India and Russia signed an agreement to purchase S-400 missiles, US President Trump said on Wednesday that India will "see" its decision on sanctions, "faster than you think." On August 2, 2017, it signed the Law on Counterattacking American Enemies with Sanctions (CAATSA). The bill stipulates that various additional restrictions are imposed on Russia, Iran and other countries, as well as on third countries that cooperate with Russian defense enterprises.

In response to Trump’s remarks, Kudashev said that India is "very big and has a wide territory, and will not rely on anyone, nor will it be afraid of anyone".

Kudashev described the S-400 agreement as "the biggest contract" and "one of the fastest contracts" in the history of military technical cooperation with India. He said that the agreement signed during the annual summit between Russian President Vladimir Putin and Indian Prime Minister Modi on October 5 will start in 2020 and will be completed within five years.

"In the next few months, you can expect more transactions. Negotiations are going on. This is a normal process. I hope that in two to three months … … We will soon reach an agreement on frigates and ak47 assault rifles. "There may be other deals," Kudashev told reporters.

When asked if India and Russia would be deterred by the threat of the Act on Countering American Enemies with Sanctions (CAATSA), Kudashev replied: "Yes. Indian Defense Minister Sitaraman and Foreign Minister Susima Swaraj also specifically mentioned that India will not recognize other sanctions outside the UN Security Council. "

Kudashev added, "The Act of Countering the American Enemy with Sanctions is very evil, and (threat) is not the right way to do things … … It is a tool for exerting political pressure and a tool for unfair competition. "

At present, India plans to buy more Talvard-class multi-purpose frigates from Russia and start producing ak-47 assault rifles, so as to make full use of the capacity of its factory to promote its "Made in India" plan.

Kudashev said that Russia expects that India will decide to build a new nuclear power project with six reactors "as soon as possible", although work on the Koodankulam nuclear power project continues. He said that the third and fourth reactors built in Kutankulam have been started, and both sides are "ready to start" work on the fifth and sixth reactors.

When talking about the new nuclear power project, he said, "The Indian government feels that it is necessary to hold more consultations with the local community (choose a site), which is still unclear."

Kudashev also criticized the U.S. strategy in Afghanistan, calling it a "failure" because the strategy has led to the deterioration of the security situation and a surge in violence. He said that India and Russia can carry out joint projects of capacity building and training in Afghanistan.

Recently, Country Garden Yang Huiyan voiced.

On March 4th, Country Garden held a monthly group management meeting, and Yang Huiyan, Chairman of the Board of Directors of the Group, attended the meeting. The information revealed at the meeting shows that with the continuous expansion of the coverage of the "white list" of real estate financing. As of March 3, 2024, Country Garden Group has included 217 projects in the "white list", and the number has increased significantly, and the existing projects have been approved by the bank for lending.

Yang Huiyan emphasized that policy support is an important support for the company to meet market challenges. Although the market demand side may not recover quickly, the government’s easing policy has provided some support for the market. Companies should actively seek the support of the government and financial institutions to form a closed loop of funds, thus ensuring delivery and operation. In addition, Yang Huiyan also said that the company’s founders and shareholders never wanted to lie flat. On the other hand, the company’s team was excellent and shared difficulties with the company. The two have formed a good positive cycle, and excellent teams have given shareholders great confidence to overcome difficulties and cross the cycle, making the company more competitive.

According to the middle finger monitoring, since the establishment of the urban real estate financing coordination mechanism, the number of projects reported by Zhengzhou, Chengdu, Chongqing, Kunming and other cities has exceeded 200, and some real estate enterprises have also entered the white list. Under the closed loop of "push-feedback" work, the opportunities for projects of real estate enterprises to obtain financing support are also expected to increase, which is conducive to further stabilizing market expectations.

According to the information disclosed at the meeting, Country Garden is actively taking measures to increase revenue and reduce expenditure, trying to reduce cash flow expenditure by reducing non-operating expenses, and actively increasing cash inflow through sales to ensure sufficient funds to support delivery and daily operations.

The data shows that in 2023, Country Garden delivered more than 600,000 houses. According to the plan, Country Garden is expected to deliver more than 480,000 sets in 2024. "The whole market is still relatively cold, and we need to be mentally prepared." Yang Huiyan said that Country Garden’s own resources can guarantee the delivery of houses this year. She also pointed out that although resources are sufficient, the problem lies in the mismatch of time and space. Therefore, we should cherish the use of resources and wait for the opportunity for the market to pick up.

Yang Huiyan said that the current problems faced by the company are consistent with the industry. In the short term, it is a liquidity problem, and in the medium and long term, it is a problem of balance sheet repair. "Although it may take a long time for the industry to recover, although the road is far away, overcoming difficulties step by step can always go out; Although things are difficult to do, they must be done. Any problem will be seriously faced and will eventually be solved. "

Mo Bin, president of Country Garden Group, stressed that the first thing to ensure delivery is to return to work in an orderly manner, which is the most important task to ensure delivery in the region at present. It is reported that Country Garden’s projects in Guangdong, Shandong, Hubei, Shaanxi, Guangxi and other places are being resumed.

On February 28th, Country Garden announced on the Hong Kong Stock Exchange that the company was informed that Ever Credit Limited (the petitioner) filed a liquidation petition with the High Court of the Hong Kong Special Administrative Region on February 27th, 2024, concerning the unpaid term loan with principal of about HK$ 1.6 billion between the petitioner (the lender) and the company (the borrower) and accrued interest. The company will strongly oppose the petition.

On the evening of March 4th, Country Garden issued a further announcement on the liquidation petition, and the company will consider whether to apply to the Hong Kong High Court for an authorization order in the light of the progress of its overseas reorganization at a later stage. The company will inform its shareholders and investors of the relevant decisions in due course and make further announcements.

Privacy clause review to improve the level of information protection

In order to ensure the effective implementation of the relevant requirements for personal information protection in the Cyber Security Law and improve the personal information protection level of network operators, the Central Network Information Office, the Ministry of Industry and Information Technology, the Ministry of Public Security and the National Standards Committee jointly held the launching meeting of the "Personal Information Protection Promotion Action" and the establishment meeting of the expert working group to launch the special work on privacy clauses. The first batch will review the privacy clauses of ten online products and services such as WeChat and Taobao.

Privacy clause is the window for users to know about the collection and use of personal information of products or services, and it is the primary channel for users to exercise the right of choice and consent given by law. Network operators should, in accordance with legal requirements, standardize the content, presentation form and location of privacy clauses, and obtain users’ consent through privacy clauses. At the same time, some people have doubts about the special work of privacy clauses. They think that on the one hand, the privacy policy is too long for users to read at all; On the other hand, the special work of privacy clause is aimed at personal information collection, but in the era of big data and Internet of Everything, it is impossible to control personal information collection. With the gradual spread of the special work of privacy clauses, the author believes that the review of privacy clauses is helpful to improve the level of personal information protection and should not give up the control of personal information collection.

The special work of privacy clause can improve the effect of notification

The most important purpose of privacy clause is to inform users. And notification is a clear requirement of China’s current laws. Whether it is the Decision of the National People’s Congress Standing Committee (NPCSC) on Strengthening the Protection of Network Information in 2012, the Law on the Protection of Consumers’ Rights and Interests in 2013, or the Cyber Security Law implemented in June 2017, individual consent is always regarded as the main legitimate reason for personal information controllers to collect and use personal information. "Agree" must be the expression of the user’s true will. In order to ensure this, notification becomes a very necessary step.

Some scholars have suggested that the framework of "inform-agree" is that the privacy policy is long and obscure, and the user is eager to use the product or service, and may directly click "agree" or "next". However, since personal information can identify specific individuals and reflect their thoughts, opinions, preferences and actions, individuals will be concerned about how their personal information is collected and used. Then, the reason why individuals show "indifference" now is that the content of privacy policy is not well displayed.

In fact, the special work on privacy clauses has made detailed consideration on how to effectively improve the effect of notification:

The first is the privacy policy, whose function is to completely and clearly describe the practices of product and service providers in collecting, saving, using and providing personal information to the outside world. Although this text is often criticized for its length, the readers of privacy policy are not only users, but also regulators and consumer protection groups. Generally speaking, the privacy clause is a public statement of network operators on their personal information processing behaviors such as collection, storage, use, sharing and transfer, which is not only a legal commitment to users, but also an important basis for network operators to carry out law enforcement and social supervision.

The second is enhanced notification, that is, registering an account, installing a program, and prompting the user about personal information when using it for the first time. It is not a text of privacy policy, but it condenses the core content of privacy policy, or highlights the information that users are most concerned about, such as what personal information is collected and to whom it will be provided. Many times, the enhanced notification contains a link to the complete privacy policy text. The advantage of this is that even if users don’t read the text of privacy policy, they can know the key core content of privacy policy and the high-risk personal information processing behavior through enhanced notification.

The third is instant prompt, that is, prompt about personal information processing behavior displayed immediately during the user’s use. It is often used to inform personal sensitive information before the second authorization. Personal sensitive information refers to personal information that may endanger personal and property safety and easily lead to personal reputation, physical and mental health damage or discriminatory treatment once leaked, illegally provided or abused. Generally speaking, personal privacy information belongs to personal sensitive information. Then, before these personal sensitive information are collected, used or provided to others (including sharing, transfer and public disclosure), users need to be reminded again, because such information is of great significance to users. From the user’s point of view, the behavior of handling personal sensitive information should not only be buried in the text of privacy policy, but should be highlighted and highlighted, with the consent of users. This is a good way to practice the concept of "user-centered".

In addition to these three forms, there are also platform-based apps. There are more single-function apps abroad, and platform-based apps are very common in China, so it is necessary to integrate many other functions. These functions may be subject to the same privacy policy, or they may have their own special provisions. Therefore, when users click on these additional functions, the providers of products and services should provide a separate notice to inform users in a targeted manner what the additional functions will do to personal information that is different from the unified privacy policy.

In fact, notification can not only be achieved through long privacy policy texts, but also through various paths in reality. If enterprises really adhere to the concept of "user-centered", they should be more creative so that ordinary users can truly feel the sincerity and temperature of products and services.

We should not give up the control of personal information collection.

Comply with the trend of the times and give up the control of the collection link, which is a typical embodiment of the supremacy of technical logic and growth. Scholars who hold this view often think that the development of artificial intelligence should be domesticated through the power of ethics and law. In fact, this debate is not unique today. In 1980, the Organization for Economic Cooperation and Development (OECD) issued a "Privacy Guidelines" guide. After entering 2000, OECD hopes to update this guide according to the characteristics of the times and technological development. Many experts convened by the OECD suggested that the 1980 guide had requirements for collection, but whether it was suitable for future development needed to be re-evaluated. After the debate, experts reached a consensus that the collection of personal information needs to be controlled. Therefore, in the updated Privacy Guidelines issued in 2013, the "collection restriction principle" was placed at the top of the eight principles of personal information protection.

It is generally believed that the protection of personal information in the United States is relatively loose, so the Internet has developed rapidly in the United States. The protection of personal information in Europe is too strict, so there are basically no decent Internet companies in Europe. But the complexity of the reality far exceeds the above simple comparison. Taking the "Privacy Protection Rules for Broadband Service Providers" formulated by the Federal Communications Commission (FCC) as an example, a framework is established in this rule: personal sensitive information should adopt the opt-in mode, and personal non-sensitive information can adopt the opt-out mode; Both personal sensitive information and non-sensitive information need to be clearly informed, and users should be provided with the right to withdraw their consent. It can be seen that the framework formulated by FCC is to strengthen the control of the collection link.

However, this rule was overturned by the US Congress not long ago. The important reason is that the framework of FCC for broadband service providers is actually stricter than the privacy protection framework of FTC for non-broadband service providers (such as Google and Facebook). Therefore, it will cause discrimination against broadband service providers in competition. However, at least ten states in the United States then tried to pass legislation at the state level to restore the framework established by the FCC.

A few days ago, Nevada also passed legislation to formally require website operators and network service providers to provide privacy policies on their websites, and put forward specific requirements for the content of privacy policies. The bill will take effect on October 1, 2017.

To sum up, the biggest market for the idea of "abandoning the collection of personal information and controlling the use of it" is in the United States, but by simply tracking the development of news and legislation, it can be found that even in the United States, such a view has not been fully accepted by legislators and regulators. Paying attention to the safety of children’s medication: from the "children’s prohibition" of Bupleurum injection

CCTV News:A few days ago, official website City, National Medical Products Administration issued an announcement to revise the instructions of Bupleurum Injection, in which "Children are forbidden" was added to the taboo. For people born in the middle and late 20th century, this is undoubtedly a kind of "emotional robbery" from childhood, so that when it is mentioned that "another commonly used drug for children has become a banned drug", many people may not remember that this drug was recommended for use because of its "few side effects", but they can always recall the "myth" of "going to the hospital with a fever, and getting an injection at their parents’ words" the disease will be cured ". … After the injection, I was still crying and being carried out of the hospital by adults.

Back to reality, Bupleurum injection will "quit" the ranks of antipyretic drugs for children. According to insiders, in pharmacy, banned drugs are the most stringent restrictions and must not be used. What does this mean? Some analysts said that this is a sign of progress, which is good from the perspectives of clinical safety, Chinese medicine supervision and economic benefits.

What are the reasons for the change from "commonly used drugs" to "prohibited drugs"?

In the 1940s, Bupleurum injection, as the world’s first traditional Chinese medicine injection, began to be used in clinic. At that time, during the Anti-Japanese War, drugs were scarce, and Bupleurum was boiled into decoction, which was further made into injection by decocting and distilling to treat fever caused by colds and malaria. In that special period, it played a certain role. According to insiders, "Bupleurum Injection" is a beneficial attempt of traditional Chinese medicine injection, but it is not a successful product.

As early as 2007, Bupleurum Injection was listed in the "List of Injections with Serious Adverse Reactions" by the State Food and Drug Administration. National Medical Products Administration requested to add warning words in the revision of the instruction manual of Bupleurum Injection. The contents should include: the adverse reactions of this product include anaphylactic shock, which should be used in medical institutions with rescue conditions. Users should be trained in anaphylactic shock rescue, and allergic reactions or other serious adverse reactions after taking the drug should be stopped immediately and treated in time. The report and monitoring of adverse drug reactions directly affect the use of drugs. An important job of hospital pharmacists is to observe, collect and sort out adverse reaction reports, and report them to the ADR monitoring center through the monitoring system at the first time. At the same time, through the analysis of the collected adverse reaction reports, preventive measures to prevent adverse reactions are put forward to ensure the safety of patients’ medication.

With the gradual improvement of drug management, the concept of disease treatment is also developing. In the past, it was said that "a shot will cure you", but now when you walk into the hospital, the slogan "You can take it orally without intramuscular injection, but you can inject it without infusion" can be seen in the fever clinics of hospitals at all levels. Insiders pointed out that at present, China’s drug use for special groups such as children and pregnant women is more strictly regulated. This is a matter of principle and is in line with international practice. At present, Bupleurum injection is widely available, safe and effective for children to reduce fever. Under the principle that it can be taken orally without intramuscular injection, it is reasonable for Bupleurum injection to be changed from a commonly used drug for children to a banned drug.

The proportion of injections in adverse drug reactions remains high. According to the National Annual Report on Adverse Drug Reaction Monitoring (2017), according to the statistics of drug administration routes, intravenous drug administration accounted for 61% of adverse drug reactions/events reports, up 1.3% over the previous year; The monitoring reports in recent two years show that injection accounts for more than 80% of the distribution of drug dosage forms involved in children’s adverse drug reactions/incidents reports. Re-evaluation of drugs after listing is undoubtedly the top priority.

What does the re-evaluation of traditional Chinese medicine injection reflect?

In the 1970s, there were more than a thousand kinds of traditional Chinese medicine injections, but there were quite a few or even the vast majority of basic research deficiencies and defects. This has also become one of the reasons for frequent adverse reactions of traditional Chinese medicine injection. In 1985, China implemented the Drug Administration Law, and the supervision of traditional Chinese medicine injections was gradually strengthened. Drugs with large side effects and low safety began to be phased out. By the 1990s, after rectification, the varieties of traditional Chinese medicine injections were 10 times lower than before — — There are more than 100 varieties. In view of the safety problems of more than 100 kinds of traditional Chinese medicine injections or stocks, in 2002 and 2006, National Medical Products Administration has been rectified twice.

The "2017 Drug Evaluation Report" released in March 2018 pointed out that the key work to be carried out in 2018 includes studying and starting the re-evaluation of traditional Chinese medicine injections and formulating the technical guiding principles for re-evaluation. It is worth mentioning that Jiao Hong, the director of National Medical Products Administration, who took office in March 2018, had been in charge of the field of medical devices for a long time. As soon as he took office, he intensively conducted research in the field of traditional Chinese medicine, and listened to the constructive opinions of relevant experts on the re-evaluation of traditional Chinese medicine injections, the supervision of traditional Chinese medicine decoction pieces and traditional Chinese medicine formula granules, and the proper handling of landmark upgrading to the national standard. Insiders pointed out that these directly refer to the problems left over from the history of traditional Chinese medicine.

In October 2017, the General Offices of the General Office of the Central Committee of the CPC and the State Council issued the Opinions on Deepening the Reform of Review and Approval System and Encouraging the Innovation of Pharmaceutical Medical Devices, proposing that the review and approval of pharmaceutical injections should be strictly enforced, and the listed pharmaceutical injections should be re-evaluated according to the progress of pharmaceutical science, so as to be basically completed in about 5 to 10 years. At that time, Bi Jingquan, the former director of the State Food and Drug Administration (now the Party Secretary of the State Administration of Markets), had to accelerate the evaluation of consistency of drug quality and efficacy, explore the methods of consistency evaluation of injection quality and efficacy, and start the re-evaluation of the safety and effectiveness of traditional Chinese medicine injections.

As early as July 2009, the State Food and Drug Administration issued a series of documents, such as "Notice on Doing a Good Job in Safety Re-evaluation of Traditional Chinese Medicine Injections", and started the re-evaluation of the safety of traditional Chinese medicine injections, which has achieved initial results.

Looking back on the road of "re-evaluation" of traditional Chinese medicine injections in recent 9 years, it can be described as twists and turns. According to insiders, the reason is nothing more than two points: high cost and lack of enthusiasm of pharmaceutical companies; It is difficult to implement and the working rules are not clear. In order to make the development of Chinese medicine industry more orderly and meet the people’s demand for drugs, we must persist in taking the people as the center, deepen the reform of the evaluation and approval system, and ensure that all reform tasks are put in place within the time limit.

Children’s safe drug use is a cliche. How to come up with new ideas?

Let’s go back to another protagonist of Bupleurum injection "Children are forbidden". There are 280 million children in our country, and the country is strong if the children are strong! Let children grow up healthily and happily, which is the greatest wish and expectation of every family, and also the foundation and support for the country to become prosperous and strong. We should always give priority to the healthy development of children and promote the priority supply of drugs for children.

At present, the current situation of children’s medication in China is as follows: among more than 6,000 pharmaceutical enterprises, there are only more than 10 enterprises specializing in the production of children’s medication, accounting for about 0.17%; There are more than 3,600 kinds of prescription drugs for adults, and only more than 60 kinds of special drugs for children, less than 1.7%; There are more than 176,000 drug approvals in China, but there are only more than 3,500 children’s drugs, accounting for only 2% of the total drug approvals.

The shortage of drugs for children is mainly affected by three factors: imperfect laws and regulations such as market access and price policy; Drug research and development is difficult, and children’s drug research and development is one of the most expensive, time-consuming and complicated fields in clinical trials, and it is difficult to recruit (children volunteers) for clinical trials; The market space is small.

The report of the 19th National Congress of the Communist Party of China proposed to improve the drug supply guarantee system. In view of the shortage of children’s drugs and the lack of research and development motivation, the state has also introduced a series of policies and measures. In the 2017 edition of the medical insurance drug list, 91 kinds of children’s drugs were added, and there were 540 drugs or dosage forms clearly suitable for children in the drug list; The priority evaluation system for children’s medication has been continuously improved, and the protection of children’s medication has been strengthened; In the State Council’s opinion on drug procurement, it is suggested that generic drugs for women and children can be directly purchased online without bidding, but these are far from enough.

To solve the problem of children’s drug shortage, some experts said that traditional Chinese medicine with relatively mild properties has become a new field of children’s drug research. Classic prescriptions, historical prescriptions and folk prescriptions have relatively exact effects on the treatment of children’s diseases and should be used scientifically and reasonably. In the government work reports of the two sessions this year, it is pointed out that it supports the inheritance and development of Chinese medicine. While inheriting ancient books, we should further promote the utilization and development of traditional Chinese medicine by means of modern science and technology. (Text/Zhang Ke)

One of the great significance of the supreme leader’s proposal of "the community of human destiny": China’s wisdom inspires the whole world.

[Editor’s note] The 2018 annual meeting of the World Economic Forum kicked off in Davos. Looking back a year ago, the Supreme Leader’s two speeches in Davos and Geneva made the idea of "the community of human destiny" shine with the light of truth, and the Hong Zhong-like loud voice still reverberates over the world. The theme of this year’s forum is "Building a common destiny in a divided world", which is an extension and inheritance of the theme of the supreme leader’s speech last year. Overseas scholars marvel that China’s wisdom inspires the whole world, China’s plan promotes the whole world, and China contributes to the prosperity of the whole world. From now on, People’s Daily launched a series of special features to explain why the world favors the "community of human destiny".

On January 17, 2017, the Supreme Leader of president attended the opening ceremony of the 2017 annual meeting of the World Economic Forum at the Davos International Conference Center, and delivered a keynote speech entitled "Sharing the responsibility of the times and promoting global development together".Xinhua News Agency reporter Lan Hongguang photo

From Moscow to new york, from Boao to Hangzhou, China’s wisdom is shining brilliantly.

Since the 18th National Congress of the Communist Party of China, the top leaders have expounded and advocated the concept of "community of human destiny" on many international and domestic occasions, continuously injected impetus into global economic development, and constantly added weight to the good development of the world situation.

At the beginning of 2017, Switzerland, one of the most active multilateral diplomatic centers in the world, welcomed the visit of the supreme leader. On January 17th and 18th, the Supreme Leader delivered two keynote speeches in Davos and Geneva respectively, which was a wonderful chapter of the concept of "community of human destiny".

The international community generally believes that the two speeches have drawn a blueprint for the development and progress of human society, and they are the supreme leader’s exquisite interpretation of China’s wisdom on the international stage, and have inspired the whole world that the concept of "community of human destiny" is a "good medicine" to deal with the tide of "anti-economic globalization" and solve world problems.

How to treat economic globalization and how to develop the world economy

Can’t retreat from the sea to the lake.

"Those who are good at treating diseases will cure their diseased places; Those who are good at saving the disadvantages will plug the source of their disadvantages. " In Davos, the Supreme Leader delivered a speech entitled "Sharing the responsibility of the times and promoting global development". This is the second time after the G20 Hangzhou Summit that he explained the road of China and used China’s wisdom to pave the way for global economic development on the world stage.

In his speech in Davos, the Supreme Leader pointed out all kinds of chaos in the current world: regional conflicts frequently occur, and global challenges such as terrorism and refugee flows are one after another.

Some people blame the root of these chaos on economic globalization, while the supreme leader used a wonderful metaphor to deny this view in his speech: "It is impossible and against the historical trend to let the world economic sea retreat to isolated small lakes and rivers."

Where is the root of the disease? "Many problems that plague the world are not caused by economic globalization." The Supreme Leader accurately pointed out that three prominent contradictions in the economic field, namely, "insufficient global growth momentum", "lagging global economic governance" and "unbalanced global development", are the root causes of the long-term downturn in the world economy, and the gap between the rich and the poor and the gap between the north and the south are more prominent.

How to prescribe the right medicine? The supreme leader provides China with wisdom: adhere to the drive of innovation and create a dynamic growth model; Adhere to synergy and create an open and win-win cooperation model; Keep pace with the times and create a fair and reasonable governance model; Adhere to fairness and tolerance and create a balanced and inclusive development model.

Everything breeds without harming each other, and Tao runs parallel without contradicting each other. "As long as we firmly establish a sense of community of human destiny, work together, share responsibility, help each other in the same boat, and tide over difficulties together, we will certainly make the world better and people happier." In his speech, the Supreme Leader once again advocated the concept of "Community of Human Destiny" which embodies China’s wisdom. This concept supported China to continue to deeply participate in the process of economic globalization and unswervingly lead the process of economic globalization.

Dai Shangxian, the Swiss ambassador to China who listened to the supreme leader’s speech at the scene, said: "This is indeed a very important moment in modern international relations." Because at this moment, the concept of the community of human destiny shines with the light of China’s wisdom on the snow and ice in the Alps.

What kind of world to build and how to build it.

"Question of Geneva" resonates with the world.

Tracing the diplomatic footprint of the supreme leader, it is not difficult to find that he always thinks about various problems of the current international community from the perspective of the trend of human society and the development of the world situation.

He delivered a speech entitled "Building a Community of Human Destiny Together" in Geneva, which vividly described the current world picture: "The world economy is weak, the financial crisis is lingering, the development gap is becoming increasingly prominent, and fighting with each other occurs from time to time. The cold war mentality and power politics are lingering, and non-traditional security threats such as terrorism, refugee crisis, major infectious diseases and climate change continue to spread."

This picture leads to the supreme leader’s "Geneva question": What happened to the world and what should we do?

Standing at the height of the development process of human history, the supreme leader took responsibility as a leader of a big country and gave a Chinese plan with the feeling of "taking the world as his own responsibility": "Building a community of human destiny and achieving win-win sharing".

Long before his visit to the United Nations, the Supreme Leader wrote in a signed article published by the Swiss media: "My visit to the United Nations Headquarters in Geneva is to review history with all parties, carry forward the diplomatic concepts recognized by all parties, explore the major proposition of building a community of human destiny, and listen to the opinions of all parties on building a better world."

Looking back at history, the Supreme Leader clarified that it is an indispensable basic follow-up to build a community of human destiny from the principle of equality and sovereignty established in the Peace Treaty of Westphalia, to the international humanitarian spirit established in the Geneva Convention, and then to the purposes and principles advocated by the Charter of the United Nations and the Bandung Conference. No matter how international relations evolve, these principles and concepts must be firm, and "one country dominates" or "several parties govern together" cannot be pursued. In the face of various contradictions and problems, "as long as we have sincere wishes, hold enough goodwill and show political wisdom, no matter how big the conflict is, no matter how thick the ice can be broken."

It is also in this speech that the Supreme Leader systematically and comprehensively put forward the "Five Persistences" for building a community of human destiny, and drew a blueprint for the development and progress of human society from five aspects: partnership, security pattern, economic development, civilized exchange and ecological construction, and provided a guide for action in building a community of human destiny.

If the world is good, China can be good; China is good, the world is better.

Welcome to the "Express Train" developed in China.

In his speech in Davos, the Supreme Leader emphasized that the key to the development of China lies in the fact that the people of China, under the leadership of the Communist Party of China, have embarked on a development path suited to China’s national conditions. He clarified that this "China Road" is a road to seek common development in opening up.

A single flower does not make a spring. Under the inspiration of the supreme leader’s concept of "Community of Human Destiny", China has always adhered to the basic national policy of opening to the outside world, pursued an open strategy of mutual benefit and win-win, constantly improved the internal and external linkage of development, and benefited more other countries and people while realizing its own development.

The Supreme Leader made a solemn commitment to the whole world, and the people of China welcomed people from all countries with open arms to take the "express train" and "free ride" developed by China. This is the internal driving force for China to push forward the process of economic globalization in the wave of "anti-globalization".

"If the world is good, China can be good; When China is good, the world will be better. "In his speech in Geneva, the Supreme Leader answered the international community with" three resolutions ":China’s determination to safeguard world peace, China’s determination to promote common development and China’s determination to build a partnership will not change.

All good principles should adapt to changing times to remain relevant. The concept of community of human destiny is the crystallization of China’s wisdom, bearing China’s lofty ideal and unremitting pursuit of building a better world, and it is also a generous gift from the supreme leader to all mankind. Some scholars call these two speeches "bright signs that China’s thoughts and theories have entered the world", which is right.

Let the fire of peace be passed down from generation to generation, let the motive force of development continue, let the light of civilization shine, and China’s wisdom enlighten the whole world.

Notice of China National Intellectual Property Administration on further cracking down on abnormal patent application agency behavior

Guo Zhi Shipping Letter No.178 [2021].

Intellectual Property Offices of all provinces, autonomous regions, municipalities directly under the Central Government and Xinjiang Production and Construction Corps:

According to the "Notice of China National Intellectual Property Administration on Deepening the" Blue Sky "Special Rectification Action" (Guo Zhi Shipping Letter No.32 [2021]), local organizations have carried out the work of cracking down on abnormal patent application agencies and achieved positive results. Our bureau found in the patent application quality monitoring and special investigation that there are still some agencies that continue to engage in abnormal patent application agency behavior. In order to further intensify the crackdown and standardize the normal order of patent application, the relevant matters are hereby notified as follows:

First, effectively increase the intensity of investigation and handling.

Our bureau is organizing a "blue sky" campaign, which will punish a group of patent agencies that have a large number of abnormal patent applications and are suspected of fabricating patents by stopping undertaking new business until their practice licenses are revoked. At present, they have entered the stage of informing before punishment. All localities should, according to the notification information about the abnormal patent application agency behavior, investigate and deal with the cases under the key supervision of our bureau and the agencies that repeatedly represent abnormal patent applications as soon as possible according to law, and severely punish them; If the circumstances are serious, it may be reported to our bureau to stop accepting its relevant agency business or revoke its patent agency qualification.

Second, strictly implement collaborative governance measures

Our bureau will determine a list of institutions that need collaborative governance according to the number of abnormal patent applications and relevant circumstances, and forward it to the intellectual property offices of relevant provinces (autonomous regions and municipalities directly under the Central Government) (the list of institutions will be forwarded separately). All localities should implement strict cooperative restrictive measures in all kinds of incentive and reward policies and project support, evaluation of institutions and individuals, screening of participating units in various activities, and recommendation of relevant experts and talents. At the same time, all localities should guide local enterprises with intellectual property advantages and demonstration enterprises to carefully select and optimize patent agencies.

Three, crack down on unqualified patent agencies related behavior.

Our bureau will continue to strengthen the screening and monitoring of big data, lock in clues that unqualified institutions engage in abnormal patent applications, and promptly hand them over to the intellectual property offices of relevant provinces (autonomous regions and municipalities directly under the Central Government) for investigation. All localities should intensify their efforts to crack down on unauthorized patent agency business, investigate and deal with it strictly and quickly, and its abnormal patent application behavior should be regarded as a heavier circumstance and given a heavier punishment.

Four, strengthen the key supervision of the per capita patent agency is obviously too high.

In the early stage, our bureau has forwarded to the Intellectual Property Offices of the relevant provinces (autonomous regions and municipalities directly under the Central Government) the list of institutions with an obviously high per capita agent volume, and asked all localities to be included in the key supervision objects as required, and conduct on-site inspections and key inspections in the "double random and one open" inspection to increase the frequency of inspections. If it is found that they are engaged in abnormal patent applications, leasing and lending patent agency qualifications, they will be severely punished according to law. Our bureau will continue to pay attention to the agencies whose per capita agent volume is obviously too high and whose agent volume growth rate is obviously abnormal, and timely transfer them to the intellectual property offices of relevant provinces (autonomous regions and municipalities directly under the Central Government) for key supervision.

Five, give full play to the role of industry organizations

Local patent agency industry organizations should give full play to the role of industry self-discipline, strengthen the self-discipline and punishment of acting as agents for abnormal patent applications, organize local activities of "promoting integrity and improving quality", cooperate with the establishment of industry voluntary supervision mechanism, strengthen special business training and policy propaganda, and guide local patent agencies and patent agents to consciously resist abnormal patent applications.

Six, strengthen the agency supervision work assessment.

Our bureau has incorporated the work of cracking down on the abnormal patent application and agency supervision into the assessment of local intellectual property protection this year, and will evaluate the progress and quality of cases transferred and supervised by our bureau in various places. At the same time, we will dispatch professionals to relevant places to conduct on-site supervision of key cases. All localities should further increase their attention, strengthen the allocation of agency supervision power, fully perform their supervisory duties, comprehensively strengthen agency supervision, resolutely curb the agency’s abnormal patent application behavior, and promote the healthy and orderly development of the agency industry.

All localities are requested to submit the requirements of this notice and the development of this year’s "Blue Sky" special action to our Intellectual Property Promotion Division before December 15, 2021.
